where are people gonna buy cigs if you ban them? the black market. who's gonna go to prison over it? marginalized people. this is already reality in authoritarian countries

That's literally a prohibition.

The point is that you're unable to buy, but you're not punished for buying. Instead, the seller is punished for selling

It stops the law from punching down on the addicts being taken advantage of (mostly)

And if you are caught with it you get charged for distribution. If you can't buy it, where did you get it?
