Unlawful presence is not a crime at all - it's a civil immigration violation.

  • If someone overstayed a visa (about 40% of undocumented people), they never committed any crime
  • Unlawful presence = civil matter handled in immigration court, not criminal court
  • No criminal penalties, just deportation/removal
