How convenient to find this entity unconstitutional 90 years after it was founded. You’d think someone would’ve noticed earlier.
The Fifth Circuit is a dumpster fire.
Time for wildcat strikes to come back. The reason the federal government officially recognized unions, was because wildcat strikes were too powerful. They pretended to make concessions while stopping the thing they feared.
Conservatives taking a big sledgehammer to the dam that's holding back a flood of labor disputes.
The NLRB isn't a tool for labor, it's a bulwark against wildcat strikes and industry lock-outs. It's a tool of government to grease the wheels of negotiation and rapidly reach settlements. Abolishing it doesn't benefit anyone, any more than abolishing the HR department benefits management or workers.
Real “tear down Chesterton’s Fence” energy in the GOP these days.
There's a certain hubris on the side of the GOP that isn't entirely undeserved.
Historically, they demolish a fence like this and it makes (some of) their donors richer. Then they knock down another fence and get richer still. Maybe they do it this time, to the same effect.
One could argue that we're hitting our limit. The dollar is sagging. Investment in the US - outside of a few petrostate oligarchies - is falling. Confidence in the US as a global source of stability is waning. But I say this as America mints its first trillionaires, so... maybe corporate business can break the back of a nascent labor resurgence without the NLRB's help.
Move Fast And Break Things has been the philosophy of American corporate expansion for the last twenty years. No reason to quit now.
Those trillionaires don't have real money though, only influence and buying power. You can't eat expected earnings. You are all suffering so a few people can be so filthy rich they can buy a country. Are you having fun?
Those trillionaires don’t have real money though
Unlimited Spending Power is real enough.
Are you having fun?
Someone certainly is.
Wait
Wait wasn't the NLRB put in place to chill unions?
Like to placate them? Like they literally armed themselves to the teeth and unions scared the shit out of owners?
Do... Does the circuit not know that or am I thinking of something else?
They don't want the placated. They want unions crushed underfoot. Trump and Co. want to bring back the days when they could use armed troops to shoot strikers and even bomb them. I'm not even joking. Trump wants a return to the robber-baron ruled gilded age.
Sounds like it's they want another fight akin to the 19th and early 20th centuries...
We need a few more sherifs like 'Ol Smiling Cid Hatfield.
Thanks for sharing, I didn't know about him. For anyone else reading this look up the Coal Wars and the Homestead Strike.
Labor has always had to kill, die, and fight against Capital for the rights we have today. They don't really teach these things in school (I think I learned about the Pinkertons in AP US History) because it would give Labor too much cultural power, but it's crucial for US citizens (and anyone really) to understand what it has taken to get to where we are.
Man that strikes me as so odd.
They live better now than the robber barons did. If we regress to such an age, their standard of living goes with it.
The only reason we have modern materials and standards is because
Well
Almost entirely because unions put the standards there.
They have no idea what they have. No idea where it comes from.
I don't think it's entirely about how they live. I really think it's more about the little people getting a decent wage and decent treatment. They don't want that. They want to be able to do anything they want to anyone they want and for their victims to have no recourse. They want power over the poor. The cruelty really is the point.
Does the circuit not know that or am I thinking of something else?
They just don't care. It's just like what they are doing with federal workers who can't use strikes as a collective bargaining tool. The MSPB was made to pacify federal workers and offer some sort of protection from partisan politics.
So trump just fired the board members so they couldn't make a quorum, and of course the supreme Court allowed it. They are relying on the fact that most Americans are too comfortable to risk jail time to stand up for their rights.
Its not just jail time, its a permeant black spot on your record that signals you’ll be “trouble” to employers and law enforcement both. Its legal fees, stigma, and being perpetually viewed with suspicion. I’m just trying to say it isn’t comfort, its fear.
Fifth circuit being fascist ghouls once again.
big return on those investments
It boggles the mind to argue that because the president is charged with faithfully executing the law there can't be a law that limits a president's authority to arbitrarily fire officials. All of these protected positions can be removed for cause. If these officials are not faithfully executing their duties in accordance with the law, that would be cause to remove them!
The problem is always that management needs to engage in some amount of work to identify people to fire "with cause" and then justify that firing. These guys don't want to fire because they built a case. They want to just Vibes Manage and do as they please. You're guilty because I say you're guilty. You're fired because I say you're fired. I win because I say I win.
For the petty aristocracy of the modern American upper class, any third party bureaucrat who steps in between them and their libidinal desires is an infringement on their God Given Right to Do As Thou Wilt.
The strong do as they please and the weak suffer what they must.
Not gonna stop until they find out how that worked for the Athenians.
Haha. Hope y'all like being slaves America. You just won the lottery of getting fucked!
Meat's back on the menu boys! *eats ceo*
This is it. Stop what you are doing. This is what will make us slaves. Its time to fight back.
