Okay, look. If we're going to be pedantic, let's be pedantic. Speaking solely on U.S. law, format shifting is legal provided you don't bypass a copy-protection mechanism which lacks an exemption granted by the Library of Congress. So, ripping a dvd in a way that circumvents css- illegal. But digitizing can be accompished via other means, video stream capture for example, and remains legal even if the most popular method is not.

I'm pretty sure that would easily be argued in court to be a method of circumventing the copy protection and thus also illegal.
