How? Trump was charged with two major crimes under Biden's DOJ.
Also unless you're a fascist like Trump you don't sick your appointment to the US Attorney General position and DOJ on anyone, let alone a political opponent. Garland and the Smith indeed did investigate and ultimately charge Trump.
They couldn't being it to trial because Trump had already previously stacked the courts, who blocked Smith at every turn.
